        Testimony given to the Daws Commission (a listing of those claiming Indian blood) states that Johnson Hembree Sr. (son of William & Orinah) was 1/4th Cherokee Indian, in another section testimony was given by Caleb Hewitt that he knew the applicant children of Elihu Hembree (named in application ) and that Elihu was a son of Johnson Hembree Sr. who he also knew personally and that Johnson Sr. was a 1/2 Cherokee Indian. Thus, Orinah was either 1/2 or full blooded Cherokee Indian.

EZEKIEL HEMBREE

    1802-1883 

Alias: Emery  

     There were several suits and counter suits between Ezekiel's heirs over his land where all the children with their current spouses were named. On June 22, 1882 (KC Deed Bk K: 156-7) Ezekiel Hembree conveyed his land to his children and 4 grandchildren stating that Phoebe was to have use of the land until her death. Those listed were: Thomas Hembree, Ewell and James Curtis heirs of Sallie Ann Curtis, John M. Hembree and Mary Johnson heirs of Nelson Hembree, Millie Johnson, John J. Hembree, Nancy Calaway, Becky Girdner, Milton Hembree, Malinda Miller, Lottie Jenkins, Susan Johnson, and Ellen Hemphill. After Ezekiel died, the children went to war.

     The suit was filed in 1885 by James Hembree (John James) and G. G. Johnson against Phoebe Goodin Hembree, A. M. Hemphill & wife, Wm. Jenkins & wife, James Miller & wife, and John Johnson. Basically, the pltfs. claimed Ezekiel had been manipulated into making the 1882 deed by Thomas, that Phoebe could not manage the land, and that Thomas had mismanaged the land and had too much influence over Phoebe. Thomas stated he had moved in a little before Ezekiel died. There were many depositions and affidavits. Phoebe deposed on July 14, 1885 that Ezekiel's mind was good when he made the deed, and that he would say things for aggravation if vexed. Thomas deposed that Ezekiel wanted to make sure that the children of Sally Curtis, decd., and Nelson Hembree, decd., received some land and that Phoebe had the use of the land until she died. Thomas also deposed that Phoebe managed and controlled the land after Ezekiel's death. Physician B. F. Main deposed that Ezekiel was fine when discuiinig business. In 1881/82 Ezekiel would still ride his horse to the mill and did the milling himself. Several neighbors called Ezekiel a "close" trader and stated his farm was worth about $4-5000. W. F. Westerfield said Ezekiel was peculiar and did not mix. Bain also called Phoebe the "most sensible woman on Brush Creek". (Box 26, Bundle 231). The court decided in favor of the defendants on Sept 15, 1886.

                    PHOEBE GOODIN HEMBREE

                              1808-1891 

On June 14, 1889, Phoebe Goodin Hembree and some of her children gave land to the Liberty Church which is on Little Brush Creek (DBM: 572-3). There is a cemetery across the road from the church where many Hembree's and Hemphill’s are supposed to be buried.

After Phoebe died, the commissioners made their report for the division of the land in Nov. 1891, the court appointed G. P. Bain to make the deeds on Dec. 28, 1891, and the deeds were made on Jan. 6, 1892.  

IMPORTANT NOTICE: In a lot of information you will find on the Internet about Phoebe Hembree, is that her name is often listed as Phoebe English Goodin. THIS IS IN ERROR. She was Phoebe Goodin, the daughter of John Goodin and Sarah Arthur aka. Sally Arthur. The English is from a misunderstanding of an item in Ezekiel's family bible. Phoebe's mother is listed as Miss Arthur English, indicating that her mother was of ENGLISH DESCENT AND NOT NAMED ENGLISH. This is a very good example of how once something gets in print, it can never be extinguished.

     On April 28, 1825 John Embry filed suit against John Leith for trespass, assault, and battery, on behalf of his daughter Patricy, an infant under the age of 21. Her deposition stated she was unmarried, that she and John Leith had agreed to be married, and then he contrived to deceive and defraud her. She asked for $2000 in damages. John Embry stated the deft. had got his daughter with child and that " he had lost the benefit of her services for a long period of time..."and asked for $1500 in damages (Box 5, bundle 41 at KY. Archives Library in Frankfort). The suit was dismissed according to the court order books.

I have received information saying that John was born September 2, 1809 instead of July, also that he might have been born in 1804. I don't know which is right. 

John HEMBREE (b. 1809, 1831 tax lists), from court records in 1837-41, had a few behavioral problems. There were presentments for public drunkenness, profane swearing, and charges of assault and battery and contempt of court. John sold land to William Laws.  

By 1841, John had sued William Johnson, Solomon Newman, Elihu Case, & George Lee on a charge of trespass. Bluford and James Hembree were called as witnesses for John (box 9, Bundle 76, KY. Archives).

Meshack Hembree first appears on the Knox Co., KY. Tax Lists in 1833, (appears as Embree) along with his father John Sr. 50 acres of land, his brother John Jr. and his brother Ezekiel 150 acres, all on Greasy Creek. Meshack is listed with 1 horse. They are all listed in 1834, 1835, and in 1836, brother James is listed as well; Ezekiel now has an additional 100 acres on Brush Creek. John Sr. and Meshack are not listed in 1837, 1838 & 1839, (assumed that John Sr. died sometime in 1836) and no Hembree's are listed in 1840.  

     Meshack listed as 28, in Anderson County, Tennessee. In 1840 Census, with 1 male under 5, William Alexander, 1 female under 5, Sarah, 2 females 5-10 Rebecca and Nancy and wife Martha also 28. They are probably in Anderson Co., as well in 1850 or possibly in Scott County, but have not been found. They are in Scott County, Tennessee. In the 1860 Census, as Meshack Embry 48 with land valued at $2000, Martha 49, Rebecca 23, William 22, Sarah, 21, Ezekiel 19, and Elizabeth 16. In the 1870 Scott County, Census they are listed as Meshack 57, Farmer, Property valued at $2100. Wife is listed as Kissiah (must be a nick name for Martha) 57, and Alvin Hembree, (Grandson, son of Elizabeth). In the 1880 Scott County, Tennessee Census Meshack is listed as 64, but would be 68 born in 1812, as a farmer; Riller (nick name for Ibey Surilla Smith aka. Isabela Z. Smith, on marriage certificate.) wife 27; son Harmon 7, daughter Mary J. (Jane) 5 and Kissiah 3. (Kissiah died July 7, 1891). A William T. Hurst 4 months was in the house as well but don't know who he was. James Martin Hembree born May 7, 1880 for some reason unknown, was in the Jeffers household at this time, but he was the son of Meshack and Ibey Hembree. Meshack & Ibey had one more child, Julia Ann b. in. 1882 and died three months (October) before Meshack died. Meshack's daughter Sarrah married Daniel Jeffers, self-taught Attorney. 

     He enlisted as a Pvt. In Captain Evan B. Jones' G Co., 2nd Regiment East Tennessee Vols. at Somerset, KY. on the 7th day of December, 1861 to serve 3 years.  He was born in Knox Co., KY.,  he was listed as 52, but would have been 49, was 5 ft. 5 inches high 135 pounds, with fair complexion, blue eyes, dark hair and by occupation when enlisted a farmer.  He was given a medical discharge on the 22nd day of January, 1863 at Nashville, TN., by reason of Surgeon's Certificate of Disability and Hemorrhoids.  He made "Oath of Identity" 19 May 1866, saying he was identical Meshack Hembree on discharge. (Sworn to Daniel Jeffers, JP. Reg. 4 June 1866. Deed Book F, pp 10-11).

Meshack applied for invalid pension from Scott County, Tennessee. On June 4, 1866, age 55, as a result of disability caused in 1862 by a barrel of salt pork striking his side during his enlistment in  the  Union Army during the Civil War. 

     Meshack's first wife, Martha divorced him on August 1, 1873, and he remarried October 16, 1873, Ibey

Smith, in Whitley County, Kentucky. Ibey died June 4, 1884, about 7 months before Meshack died. The divorce by Martha stated that Meshack had committed adultery with Rilla (Ibey) Smith. Martha's maiden name was Carroll, which she was to reassume after the divorce. The court took Meshack's land and conveyed it to Martha as a life interest. As a result of this divorce, Meshack left three minor children when he died with no means of support. ( their mother had died in 1884 ). Meshack's son, William Alexander was appointed as their guardian and he applied for a pension to support Meshack's children on September 22, 1890. The children were, Mary Jane b. July 15, 1874; Kissie b. November 18, 1876 & James Martin b. May 7, 1880.  

     Meshack died January 21, 1885 at William Alexander Hembree's home on Smokey Creek, Tennessee and is buried with Martha, Ibey, William Alexander & Emily Shoopman Hembree and many other Hembree's, Low's, Lowe's are buried in the Hembree Cemetery on Smokey Creek near Smokey Junction, outside Huntsville, Tennessee.

Charge: Left the petitioner without any cause and was living with another woman to whom he had married since the abandonment.  The petitioner to be restored to all the rights and immunities of a feme sole.  At the time the said Bluford Hembree abandoned the petitioner she had in her possession a small amount of personal property and has said property at the present  time.  The Court is pleased to order, adjudge and decree that the time to said articles of personal property be vested in petitioner and that the said Bluford Hembree be perpetually enjoined from interfering with or in any manner disposing of or disturbing petitioner in the enjoyment of the same.  Source:  Circuit Minutes, 1865-1870, pp 9010.
